The Visa Waiver Program's bargain is stark: 90 days of easy entry in exchange for near-zero forgiveness. For British and other VWP travellers, the consequences of missing the date are among the harshest in the immigration world, and the most common cause is misreading which date matters. The date that governs: your I-94, not your ESTA

An ESTA authorisation lasts two years and permits multiple visits; it is not your permitted stay. Each entry generates an electronic I-94 record with an admit-until date, checkable at the official CBP I-94 site, and that date is the law of your visit. The 90 days run per admission, arrival day included, and there is no extension and no status change on VWP in almost all circumstances: the flexibility a B-2 visitor has simply does not exist.

What an overstay costs

  • VWP eligibility, permanently. Overstay once, even briefly, and you can no longer travel visa-free: every future trip requires applying for a visa at an embassy, where the overstay is on file.
  • Unlawful presence bars: accrue more than 180 days of unlawful presence and leave, and you trigger a 3-year bar; more than a year, a 10-year bar (see the State Department on ineligibilities and waivers).
  • Removal without a hearing: VWP entrants waive most rights to contest removal.
  • The record is durable: biometric entry data means the history follows your passport renewals.

The counting mistakes

The Canada/Mexico wrinkle catches many: short hops to Canada, Mexico or adjacent islands generally do not reset the 90 days; you are readmitted for the balance of the original period.
