How Long Can UK Citizens Stay in the USA? ESTA, the B-2, and the Tax Line (2026)

The two big flows in our readership finally meet: after covering Americans in Europe exhaustively, here is the reverse trip. British passport holders have two realistic ways into the United States as visitors, with very different ceilings. Updated 10 August 2026.

Route one: ESTA, 90 hard days

Under the Visa Waiver Program, UK citizens travel with an ESTA: up to 90 days per visit, arrival day included, governed by the I-94 date issued at entry (check it at CBP's official site). Two hard edges: no extensions, essentially ever, and no reset from hopping to Canada or Mexico, you are readmitted for the balance of the same 90. Route two: the B-2 visa, up to six months

For longer visits, the B-2 visitor visa allows admission typically up to six months, with extensions possible from inside the US. The costs are friction (embassy interview, demonstrating ties to the UK) and scrutiny: repeated near-maximum stays invite questions about whether you are visiting or living. For British owners of Florida property who winter there, the B-2 is usually the honest instrument; the ESTA is not built for five-month winters.

The tax line nobody warns visitors about

Immigration legality and tax residency are separate machines. Days in the US count toward the Substantial Presence Test's weighted three-year formula, and a repeating pattern above roughly 121 days a year meets it, making you a US tax resident on paper while your visits were perfectly legal.
