British Snowbirds in Florida: The Visa Ceiling, the US Tax Formula and the UK Side (2026)

Thousands of British households winter on the Gulf Coast, and most manage the trip on folklore. The reality is three clocks running at once: a visa ceiling, a US tax formula, and the UK's own residence test. Updated 10 August 2026.

Clock one: the visa ceiling

An ESTA's 90 days cannot cover a five-month winter, has no extensions, and does not reset via a Bahamas cruise or Mexico hop (balance-of-stay readmission). Clock two: the US tax formula

The Substantial Presence Test counts this year's days plus a third of last year's plus a sixth of the year before against 183. A steady 150-day winter computes to 225 weighted days, comfortably over the line, despite never nearing six months in any single year. The break-even repeating pattern is about 121 days a year. Between there and 182 actual days, the answer is usually the closer connection exception, claimed annually on Form 8840, exactly as for Canadian snowbirds, whose guide covers the formula in full. Florida's lack of state income tax spares you the state layer (other states differ), but the federal formula applies in Naples as much as New York.

Clock three: the UK side

Your months abroad also feed the Statutory Residence Test. For most retired snowbirds this is benign, you remain comfortably UK resident and taxed accordingly, but anyone using long winters as part of a plan to leave UK tax residence needs the ties-band arithmetic, and anyone drifting toward US residency needs the treaty tie-breaker picture. The one unambiguous rule: whichever outcome you want, it is proven with a day log.
